CustomVocalz LLC — Terms of Service (Unified Version)
Effective Date: January 1, 2025
Governing Law: State of Wisconsin
By accessing or using CustomVocalz LLC (“CustomVocalz,” “we,” “our,” “us”), you agree to the following Terms of Service. These Terms apply to all artists, users, and participants within the CustomVocalz ecosystem, including CVLiveStream and the Founders Club. If you do not agree, you may not use the platform.
CustomVocalz is an original‑music ecosystem. All music uploaded must be 100% original, fully owned by the artist, unreleased on any external DSP, free of copyrighted samples unless cleared, and not previously distributed or assigned an ISRC by any other distributor. You represent and warrant that all content you upload is your original work and that you hold full legal rights to distribute it. CustomVocalz uses audio fingerprinting, DSP‑matching systems, metadata scanning, and ISRC detection to verify originality. If your content matches previously released material, CustomVocalz may reject, remove, or void the track, terminate your account, forfeit royalties, and issue no refunds. These actions may occur before or after publication.
You may not upload copyrighted or previously released music, AI‑generated music you do not own, uncleared samples, fraudulent metadata, impersonations, or any content that violates applicable law. Violations may result in immediate termination without refund.
Royalties are earned only from streams generated within CustomVocalz. Only verified, original uploads qualify. Royalty splits are determined by your active subscription tier: Tier 1 at 70%, Tier 2 at 80%, Tier 3 at 100%, Tier 4 at 100%, and Tier 5 under custom label agreement. Royalties are forfeited if tracks are non‑original, DSP‑matched, fraudulent, disputed, or tied to accounts terminated for violations. Payments follow monthly or quarterly cycles, require accurate tax documentation, and are processed through Stripe/ACH. CustomVocalz is not responsible for delays caused by banks or processors. CustomVocalz maintains a strict no‑refund policy for terminated accounts, DSP‑matched uploads, fraudulent uploads, subscription fees, or violations of originality rules. Chargebacks may result in termination and legal action.
By uploading content, you grant CustomVocalz a limited, worldwide, non‑exclusive license to host, stream, display, promote, monetize, and feature your content within the platform. You retain full ownership. This license ends when you delete your content, except where legal or financial obligations require retention. You agree to provide accurate metadata, including artist name, producer credits, writer credits, and release information. Fraudulent metadata may result in removal or termination.
CustomVocalz may suspend or terminate accounts for non‑original uploads, copyright violations, fraud, chargebacks, abuse of platform tools, or any violation of these Terms. Upon termination, all royalties are forfeited, all uploads removed, no refunds issued, and access revoked. Termination may occur without notice.
The Founders Club is limited to the first 100 artists selected by CustomVocalz. Founders Club artists may receive early placement, priority review, exclusive features, and A&R development opportunities. CustomVocalz reserves full discretion over selection, removal, and benefits.
CVLiveStream is available to verified artists. CustomVocalz may feature, promote, or remove livestreams at its discretion. Livestream content must follow all originality and copyright rules.
CustomVocalz complies with the Digital Millennium Copyright Act (DMCA). You may submit takedown notices or counter‑notices. Repeated copyright violations may result in termination.
CustomVocalz is not liable for loss of earnings, delayed payouts, removed content, account termination, technical issues, third‑party disputes, or misuse of the platform. Your use of CustomVocalz is at your own risk. CustomVocalz may modify these Terms, adjust royalty policies, update platform features, remove content, terminate accounts, or change subscription tiers at any time. All decisions are final.
These Terms are governed by the laws of the State of Wisconsin. All disputes must be resolved through binding arbitration in Wisconsin. No class actions are permitted. Continued use of the platform constitutes acceptance of updated Terms.
